It should be noted that not all debt is covered under the Fair Debt Collection Practices Act. Typically, this legislation only applies specifically to personal or household debt, such as car payments, mortgages, student loans, and the like. Debts related to a business may not be protected by this law, though there are other federal restrictions on how collectors must behave. Additionally, the FDCPA usually does not apply if the collector is the original creditor to whom you owe the money. It is most often used as a way to go after the harmful practices of individuals or agencies that purchase your debt from the original creditor and then hound you for repayment. These state homestead laws are for more than just bank accounts, though. Up to $50,000 in equity in a home in which you or your dependents live. You can use the previous three exemptions up to $100,000. If you co-own any of these properties, you must multiply $100,000 by your fraction of ownership in order to get your max exemption number. The biggest reason to consolidate is to bring your APR down. If your consolidation loan isn’t doing that for you, you’ll want to run the math using an online calculator to see if taking out the loan would actually save you money. Another way to get a handle on your debt is to refinance. For example, maybe your auto loan payments are just too much for you to manage on a monthly basis. You could refinance for a lower monthly payment, though there is a strong chance you’ll end up paying more over the life of your loan if your refinance spreads your repayment term over a longer time period. Another example of using a refinance to better manage your debt is a mortgage refinance. Let’s say you bought a home in the early aughts, when the APR on mortgages was much higher than it is today. By refinancing at today’s rates, there’s a good chance you’ll be able to bring your APR down, especially if you do not extend the repayment terms with your refinance. The last arena where you’ll typically find refinancing is with student loans.

Balance transfers are when you take the balance you owe on one card and transfer it to another, typically for fee that’s somewhere in the 3 to 5% range. The key to successfully using a balance transfer is to find an offer for 0% introductory APR. That way you cut down on what you’re being charged every month in terms of interest. This strategy is not going to work if your credit is shot, as you likely won’t qualify for the new card. It’s also not a good idea to implement if you have a history of bad credit card habits. If you’re just going to rack up more debt now that your balance has been transferred to a new card, using a balance transfer isn’t advantageous.

The next step is to file a complaint in writing. You can also file a complaint if you don’t have a witness to these conversations, but a witness will help. The correct agency to submit your complaint with is the FTC. Next, complain to your state consumer protection agency. Then, mail a copy of your complaint to the creditor who hired the collection agency. If the infractions are serious enough, the creditor may stop the collection efforts. In the event the infractions are on-going, you can sue the collection agency (as well as the creditor that hired the agency) for up to $1,000.00 in small claims court for violating the FTC laws (note: you probably won’t win if you’re able to prove only a few minor violations). If the infractions are outrageous, you can sue the collection agency and creditor in regular civil or small claims court. Some debt collectors do employ collection methods involving the use of false and misleading statements. As with every other high pressure salesman, these people will make lots of “helpful” tips to help you to close the sale NOW.
